As of September 2021, the new rules for mutual divorce in India 2022 require couples seeking divorce to live apart for at least one year before filing for mutual divorce. This waiting period can be waived if the couple can prove that they have been separated for a period of at least two years. The couple must also come to an agreement on issues such as property division, spousal support, and child custody before filing for mutual divorce. The divorce petition must be filed jointly by both parties, and both parties must be present in court for the divorce to be granted. The new rules also allow for video conferencing to be used if one of the parties cannot be physically present in court.
